## §1 Privacy Policy

Applies under Regulation (EU) 2016/679 (GDPR) and, where applicable, the California Consumer Privacy Act (CCPA).

### 1.1 Controller

StoryPulseWorks, Malteserstraße 112, 12249 Lankwitz, Germany, is the data controller for personal data processed through this website and related correspondence. Contact: [email protected].

### 1.2 Categories of data

We may process: name, email address, phone number, organization, project brief text, billing details required for invoices, and technical logs (IP address, user agent, timestamps) needed to secure the service.

### 1.3 Purposes & legal bases

• Responding to inquiries and delivering contracted copywriting services — Art. 6(1)(b) GDPR (pre-contract / contract).

• Sending transactional notices and invoices — Art. 6(1)(b) and Art. 6(1)(c) (legal obligation, e.g. German commercial and tax law).

• Improving site reliability and preventing abuse — Art. 6(1)(f) GDPR (legitimate interest).

• Optional marketing communications — only with consent, Art. 6(1)(a) GDPR; withdraw anytime via [email protected].

### 1.4 Recipients & processors

Data may be shared with hosting, email, payment (e.g. Stripe), and analytics processors acting under Art. 28 GDPR agreements. We do not sell personal information. Payment card data is handled by the payment provider; StoryPulseWorks does not store full card numbers.

### 1.5 International transfers

If a processor operates outside the EEA, transfers rely on adequacy decisions or Standard Contractual Clauses plus supplementary safeguards.

### 1.6 Retention

Inquiry data: up to 24 months after last contact. Contract and invoice records: as required by German law (commonly 6–10 years). You may request earlier deletion where no overriding legal duty applies.

### 1.7 Your rights

Access, rectification, erasure, restriction, portability, and objection (Art. 15–22 GDPR). Complaint right with a supervisory authority (Berlin Commissioner for Data Protection and Freedom of Information for our establishment). CCPA consumers may request disclosure or deletion and may opt out of “sale” — we do not sell data as defined by the CCPA.

### 1.8 Security

TLS encryption in transit, access control, least-privilege credentials, and backups. No method is perfectly secure; we notify affected clients of personal-data breaches without undue delay where required.

### 1.9 Children

Services are B2B and not directed at children under 16; we do not knowingly collect their data.

## §2 Terms of Service

### 2.1 Scope

These terms govern copywriting, whitepaper, messaging, and related advisory services supplied by StoryPulseWorks (Malteserstraße 112, 12249 Lankwitz, Germany) to its clients. Individual statements of work (SOW) or order confirmations prevail where they expressly conflict.

### 2.2 Formation of contract

A contract forms when StoryPulseWorks confirms an inquiry in writing (email sufficient) or when a paid invoice for a scoped package is issued and accepted. Website content is an invitation to inquire, not a binding offer.

### 2.3 Fees, payment & late payment

Prices are stated per package (e.g. $490–$1,800) unless a custom quote says otherwise. Fifty percent (50%) kickoff and fifty percent (50%) on final delivery is standard for custom work; fixed packages may be invoiced 100% upfront. Payment links route to Stripe. Invoices are due within 14 days. Late amounts may accrue statutory default interest (§§ 288, 247 BGB) and a flat €40 recovery fee for consumers where applicable.

### 2.4 Client duties

Clients provide accurate brief materials, timely feedback, and rights to any trademarks, data, or assets supplied. Delays in feedback extend delivery dates day-for-day. You confirm that materials you provide do not infringe third-party rights.

### 2.5 Delivery, revisions & acceptance

Durations listed on the website are business-day estimates from kickoff and complete inputs. Packages include two (2) focused revision rounds unless the SOW states otherwise. Materially conforming deliverables are deemed accepted upon delivery if not rejected with specific defects within five (5) business days.

### 2.6 Intellectual property

Upon receipt of full payment, StoryPulseWorks assigns to the client the economic rights in the final client-specific deliverables, to the extent needed for the client’s intended use. StoryPulseWorks retains rights in pre-existing frameworks, templates, methods, and generic know-how, and may reuse non-confidential techniques. Third-party assets (stock, fonts, licensed research) keep their own license terms.

### 2.7 Confidentiality

Each party keeps the other’s non-public business information confidential for three (3) years after engagement end, excluding information that is public or independently developed.

### 2.8 Compliance & advertising claims

Clients remain responsible for legal review of regulated claims (health, finance, etc.). StoryPulseWorks drafts persuasive copy in good faith and will flag obvious compliance risks but does not provide legal advice.

### 2.9 Liability

Unlimited for intent, gross negligence, injury to life/body, and mandatory product liability. For ordinary negligence, liability is limited to foreseeable, typical contract damage — capped at the fees paid for the affected order in the prior twelve (12) months — except where a cardinal obligation is breached. Claims for lost revenue that depend on client-side conversion outcomes are excluded; past performance is not a warranty of future results.

### 2.10 Term & termination

Project engagements end on delivery and final payment. Either party may terminate for cause with written notice if the other materially breaches and fails to cure within 14 days. Retainers (if any) cancel with 30 days’ notice.

### 2.11 Governing law & forum

German law excluding the UN CISG. Mandatory consumer venue rights are preserved; for merchants, registered entities, and public bodies, Berlin courts. EU consumers may also sue in their member-state domicile.

### 2.12 Severability

If a clause is invalid, the remainder stays effective; parties replace it with a valid clause that matches the economic intent.

## §3 Cookie Policy

### 3.1 What we use

• spw_cookie_ok — localStorage flag recording that you dismissed the consent toast (essential, first-party, persists until cleared).

• Session/security cookies required to deliver pages over HTTPS and prevent request forgery where forms are posted to a backend.

• Optional analytics cookies (if enabled) to count visits and popular services — set only after consent where GDPR requires prior opt-in.

### 3.2 Purpose

Essential cookies keep navigation, payment redirects, and security working. Analytics, when active, help us improve content structure — never for cross-site ad profiling by us.

### 3.3 Third parties

Embedded maps (Google Maps iframe) and Stripe checkout may set their own cookies when you interact with those embeds. Their policies govern those cookies. Loading a map for directions can be done without accepting optional analytics.

### 3.4 Managing cookies

Use your browser settings to block or delete cookies at any time. Blocking essential storage may degrade features (e.g. the banner may reappear). Withdraw consent for optional cookies by writing [email protected].

### 3.5 Duration

Consent storage flag: until browser data is cleared. Session cookies: deleted on browser close. Analytics cookies (if used): maximum 13 months.

## §4 Refund Policy

### 4.1 Cooling-off for consumers (EU)

If you are a consumer under EU law and contract at a distance, you have a 14-day right of withdrawal (§ 355 BGB / Dir. 2011/83/EU). If you expressly ask us to start the service before the deadline ends, you owe the proportionate value for work already performed. To withdraw, email [email protected] with your order reference before the 14 days expire.

### 4.2 Project cancellations

• Before kickoff — full refund of amounts paid, less non-recoverable third-party costs already incurred (if any).

• After kickoff, before first draft — refund of fees minus 30% of the package price to cover discovery and planning time.

• After first draft delivery — no automatic refund; remaining rounds still apply under §2.5. You may stop further work in writing; unpaid invoices for completed milestones remain due.

### 4.3 Defective delivery

If deliverables materially miss the agreed brief, report defects in writing within 10 business days. We will remedy within a reasonable time (revision or, at our choice, redelivery). If cure fails, you may reduce the price (§ 636 BGB) or terminate for cause. This is the exclusive warranty remedy for digital content/services to the extent permitted by law.

### 4.4 Non-refundable items

Fully delivered and accepted work, rush fees for expedited slots already reserved, and used third-party licenses (stock, tools) are non-refundable once consumed. Gift-style promotional discounts are not redeemable for cash.

### 4.5 How refunds are paid

Approved refunds return to the original payment method (typically Stripe) within 10 business days of approval. Bank fees for international wires, if any, are borne by the requester where legally allowed.

### 4.6 Chargebacks

Contact us first at [email protected] — good-faith disputes resolve faster than card-network reversals. Abuse of chargebacks for delivered, accepted work may result in refusal of future engagements.
